Welcome to Spark! These Terms of Use ("Terms") govern your use of the Spark mobile application (the "App") operated by Jakub Sobotka ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the App.

2. Description of Service

Spark is a mobile application designed for couples and partners to engage in meaningful conversations through curated questions, share responses, and strengthen their relationships. The App includes both free and premium features accessible through subscription.

3. Eligibility

3.1 Age Requirements

• You must be at least 13 years old to use the App
• Users under 18 must have parental consent
• We recommend the App for mature users who can engage responsibly with relationship content

3.2 Account Responsibility

• You are responsible for maintaining the confidentiality of your account
• You agree to provide accurate information
• You are responsible for all activities under your account

4. User Conduct

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App to harass, abuse, or harm others
• Share inappropriate, offensive, or explicit content
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the App or other users' accounts
• Use the App for commercial purposes without authorization
• Share your pairing codes with unauthorized individuals
• Impersonate others or provide false information

4.2 Content Guidelines

When using the App, you agree that all content you share:

• Is appropriate for a relationship-focused platform
• Respects your partner's privacy and consent
• Does not violate any third-party rights
• Complies with applicable laws

4.3 Pairing Responsibility

• Only pair with individuals you know and trust
• Respect your partner's privacy and boundaries
• Do not share pairing codes with multiple people simultaneously
• Understand that both partners can see shared content

5. Privacy and Data

5.1 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

5.2 Content Sharing

• Content you share within the App is visible to your paired partner
• You retain ownership of your content but grant us necessary rights to operate the service
• We do not share your private conversations with third parties except as outlined in our Privacy Policy

5.3 Data Security

While we implement security measures, you acknowledge that no system is 100% secure. You use the App at your own risk regarding data security.

6. Subscription and Premium Features

6.1 Premium Subscriptions

• Premium features are available through auto-renewing subscriptions
• Subscription terms and pricing are displayed in the App
• Subscriptions are processed through Apple's App Store and governed by Apple's terms

6.2 Payment and Billing

• Payment is charged to your Apple ID account
• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• You can manage and cancel subscriptions through your Apple ID settings
• No refunds for unused portions of subscription periods

6.3 Free Trial

• Free trials may be offered for premium features
• Free trials automatically convert to paid subscriptions unless cancelled
• Previous free trial users may not be eligible for additional free trials

7. Intellectual Property

7.1 App Content

The App, including its design, features, questions, and functionality, is owned by us and protected by intellectual property laws.

7.2 User Content

• You retain ownership of content you create
• You grant us a license to use, store, and display your content as necessary to provide the service
• You represent that you have the right to share any content you upload

7.3 Restrictions

You may not:

• Copy, modify, or reverse engineer the App
• Extract or attempt to extract source code
• Create derivative works based on the App
• Use our intellectual property without permission

8. Disclaimers and Limitations

8.1 Service Availability

• The App is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We may modify, suspend, or discontinue features at any time

8.2 Relationship Advice Disclaimer

• The App is for entertainment and communication purposes only
• We do not provide professional relationship counseling or therapy
• Content and questions are not a substitute for professional advice
• We are not responsible for relationship outcomes or decisions made using the App

8.3 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months
• We are not responsible for content created by users or relationship outcomes

9. Termination

9.1 Your Right to Terminate

You may stop using the App and delete your account at any time by contacting us or using in-app deletion features.

9.2 Our Right to Terminate

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in harmful or illegal activities
• Abuse the service or other users
• Fail to pay subscription fees

9.3 Effect of Termination

Upon termination:

• Your access to the App will cease
• Your data may be deleted according to our Privacy Policy
• These Terms will continue to apply to any remaining obligations

10. Updates and Changes

10.1 App Updates

We may update the App to add features, fix bugs, or improve performance. Some updates may require you to agree to revised Terms.

10.2 Terms Changes

We may modify these Terms at any time. Material changes will be communicated through:

• In-app notifications
• Email notifications (if provided)
• Updated posting date on this document

Continued use after changes constitutes acceptance of new Terms.

The App integrates with third-party services:

• Firebase/Google: For app infrastructure and analytics
• RevenueCat: For subscription management
• Apple Services: For app distribution and payments

Your use of these services is subject to their respective terms and conditions.

These Terms are governed by applicable laws without regard to conflict of law principles.

12.2 Dispute Resolution
